3. ELIGIBILITY: The Promotion is only open and offered to people who are over the age of 18, or the age of majority in the relevant jurisdiction, whichever is older, and are legal residents of one or more of the following regions:

The Diablo IV open beta is scheduled to be available between March 24 – 26, 2023 PT, or such other time(s) as announced by Sponsor at https://www.diablo4.com 49 (the “Diablo IV Open Beta Period”). Due to the nature of beta testing a pre-released game, availability and dates for the Diablo IV open beta are subject to change at any time without prior notice, and may vary by platform. Availability of the Diablo IV open beta is also subject to possible outages and time zone differences.
4. HOW TO ENTER: To enter the Promotion, eligible participants must (i) log in to their Blizzard Battle.net account and opt in to the Promotion at https://www.diablo4.com/betasweepstakes 73 during the Promotional Period, (ii) sign in to the Diablo IV open beta using the same Blizzard Battle.net account and start a new in-game character during the Diablo IV Open Beta Period, and (iii) reach the maximum available character level with such character prior to the end of the Diablo IV Open Beta Period. Limit one (1) entry per person. Entries received from any person, account or email address in excess of the stated limit will be void. Entries generated by script, macro or other automated means are void.
5. PRIZES: One (1) eligible entrant residing in the North America Region, one (1) eligible entrant residing in the Latin America Region, one (1) eligible entrant residing in the Asia-Pacific Region, and one (1) eligible entrant residing in the Europe Region will be randomly chosen by Sponsor or their appointed independent designee using a verifiably random method of selection to have their likeness painted into a Diablo IV-themed mural (“Mural”), which has an approximate retail value of Zero US Dollars ($0 USD) (the “Prize(s)”). The Sponsor’s decision is final. No correspondence will be entered into. Winners will be contacted via the email address associated with the Blizzard Battle.net Account used to enter the Promotion. Winners must respond within twenty-four (24) hours of notification with three (3) photos of their face which meet all requirements in the notification, along with all complete and executed Legal Documents requested in the notification. Sponsors reserve the right to disqualify any Winner who Sponsor has reason to believe has provided a photograph or any other personal data of any third-party individual in place of their own. Winners who do not respond with the forgoing within twenty-four (24) hours of notification will forfeit their Prize, and another winner will be randomly chosen in their place. PRIZE RESTRICTIONS: Prize recipients will be required to execute an affidavit of eligibility, publicity release, and other documentation as required by Sponsor (“Legal Documents”) as a condition of receiving the Prize. Winners waive all rights of approval over the use of their likeness by Sponsor and Sponsor’s licensees. There are no alternatives to these prizes. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any Prize. Except where prohibited by applicable law, all Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability, fitness for a particular purpose or non-infringement). 8. REQUIRED PUBLICITY: Each Prize winner must agree to participate in publicity activities related to the Promotion as may be required by Sponsors. The grant of rights set out above shall include an assignment of all moral rights accruing to Participant or, in jurisdictions where such assignment is not permitted by law, a waiver of such moral rights and an agreement by Participant not to institute or support any claim based on moral rights against Sponsor, and to the extent Participant is not permitted to waive moral rights by law, Participant hereby permits Sponsor (or any successor or transferee thereof) at any time to modify or to change the Participant Materials or to accompany the Participant Materials with any illustrations, prefaces, after-words, comments and other materials and Participant confirms that such amendments, changes or accompaniment will not cause harm to their honor or reputation and does not constitute a distortion or mutilation of the Participant Materials. Participant acknowledges and understands that moral rights include the right of an author to be known as the author of a work; to prevent others from being named as the author of the works; to prevent others from falsely attributing to an author the authorship of a work which the author has not in fact created; to prevent others from making deforming changes in an author’s work; to withdraw a published work from distribution if it no longer represents the views of the author; and to prevent others from using the work or the author’s name in such a way as to reflect on the author’s professional standing. Participant further agrees to take, at Sponsor’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor’s rights as set forth above in this paragraph.
10. SPONSORS’ RIGHTS: Sponsor reserve the right at any time, in their absolute discretion, to:
verify the eligibility of any participant (including their age and place of residence);
disqualify any participant found to be abusing or tampering with the operation of the Promotion or entering using fraudulent means, or who the Sponsors believes to have acted in breach of these Official Rules; and
